1. Accepting these terms
These Terms of Service ("Terms") are an agreement between you and Cascade Programming Solutions Inc., which operates Optyfind ("Optyfind," "we," "us," or "our"). By creating an account, purchasing a plan, or using the Optyfind website, web application, Chrome extension, or related services (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Optyfind monitors public company career pages and other supported job sources, filters listings using profile and search information, and provides tools for saving jobs and tracking applications. The Chrome extension can help recognize or save listings from supported third-party pages.
Optyfind is a job-search and organization tool. We are not an employer, recruiter, employment agency, or representative of the companies whose listings appear in the Service.
3. Eligibility and accounts
You must be at least 18 years old or the age of legal majority where you live, whichever is higher, and able to enter into a binding agreement. You agree to provide accurate account information, keep it current, keep your credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account unless caused by our failure to use reasonable safeguards.
Accounts are personal and may not be sold, transferred, or shared in a way that allows multiple people to avoid applicable plan limits.
4. Job listings and matches
Job listings originate from employers and other third-party sources. Although we work to keep information useful and current, we do not guarantee that a listing is accurate, complete, available, or still accepting applications. You should verify important details with the employer before relying on a listing or applying.
Match scores, filters, notifications, and recommendations are informational tools. They do not guarantee an interview, offer, employment outcome, or that a role is appropriate for you. You remain responsible for your application decisions and communications with employers.
5. Acceptable use
You may not use the Service to:
- violate law, third-party rights, or these Terms;
- submit false, deceptive, harmful, infringing, or unlawful content;
- access another person's account or probe, bypass, or interfere with security controls;
- scrape, crawl, copy, or extract the Service at scale except through an interface we expressly provide;
- reverse engineer or attempt to discover non-public source code, except where law prohibits this limit;
- introduce malware, overload infrastructure, disrupt the Service, or automate abusive requests; or
- resell, sublicense, or commercially exploit the Service without our written permission.
6. Browser extension and third-party services
The Chrome extension requires browser permissions to identify supported job pages, communicate with your Optyfind account, and save listing information at your request. You can disable or remove the extension using your browser controls.
The Service may link to employer sites, applicant tracking systems, job boards, or other third-party services. We do not control those services and are not responsible for their content, availability, security, or privacy practices. Your use of a third-party service is governed by its own terms and policies.
7. Plans, billing, and cancellation
Some features require a paid subscription. Current plan features and prices are shown before purchase. Taxes may be added based on the billing information you provide. Payment processing is handled by Stripe.
Paid subscriptions renew automatically for the selected monthly or annual billing period until cancelled. By subscribing, you authorize recurring charges to your selected payment method. Annual prices may be shown as a monthly equivalent but are billed for the full annual period unless the purchase screen states otherwise.
You can cancel a paid subscription through the Service. Cancellation takes effect at the end of the current paid billing period, and you retain paid access until then. Except where required by law or expressly stated at purchase, fees already charged are non-refundable and we do not provide credits for a partially used billing period. Plan features, limits, and prices may change prospectively; we will provide notice of changes that materially affect an active paid subscription where required.
8. Your content and feedback
You retain ownership of information and content you submit to the Service. You give us a limited, non-exclusive licence to host, process, reproduce, and display that content only as reasonably necessary to operate, secure, and improve the Service and comply with law. You confirm that you have the rights needed to provide that content.
If you voluntarily provide feedback or suggestions, we may use them without restriction or compensation, provided we do not publicly identify you without permission.
9. Our rights
The Service, including its software, design, branding, and original content, is owned by Optyfind or its licensors and is protected by intellectual-property laws. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. They do not transfer any ownership rights to you. Third-party job-listing content remains the property of its respective owner.
10. Privacy
Our Privacy Policy explains how we collect, use, disclose, and retain personal information. By using the Service, you acknowledge those practices.
11. Service changes and availability
We may add, change, suspend, or discontinue features to maintain and improve the Service or respond to legal, security, or business needs. We do not guarantee uninterrupted or error-free availability. When reasonably possible, we will provide notice if a material change significantly reduces the core functionality of an active paid plan.
12. Suspension and termination
You may stop using the Service at any time. You may request account deletion through our contact form. Cancelling a subscription does not by itself delete your account.
We may restrict, suspend, or terminate access if you materially breach these Terms, create risk or legal exposure, fail to pay applicable fees, or use the Service fraudulently or abusively. Where appropriate, we will provide notice and an opportunity to remedy the issue. Provisions that by their nature should continue after termination will survive, including ownership, disclaimers, liability limits, and dispute terms.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Optyfind disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the Service or any job listing, match, recommendation, or third-party link will be accurate, complete, secure, available, or suitable for your needs. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Optyfind and its directors, officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, data, goodwill, or business interruption arising from the Service.
To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of CAD $100 and the amount you paid to Optyfind in the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.
15. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer rights in your home jurisdiction, disputes will be brought in the courts located in Ontario, Canada.
16. Changes to these terms
We may update these Terms as the Service or legal requirements change. We will post the revised Terms here and change the "Last updated" date. For material changes, we may also provide notice through the Service or by email. Continued use after the updated Terms take effect means you accept them, except where law requires a different form of consent.
17. Contact us
